Richard Tummey/Toomey ....Sheep Stealing (General)

by sidtoomey01 @, Brisbane, Queensland, Australia, Tuesday, October 06, 2015, 21:51 (3345 days ago)

Can anyone point me in the right direction please ?
Richard Tummey/Toomey was convicted at the 1786 Gloucester Assizes for the capital offence of sheep stealing. This was reprieved to seven years transportation. As this date was before transportation to New South Wales, I assume he went to USA or the West Indies. Are there records available covering transportation of convicts to these countries ?
I am also trying to find a record of his trial, hoping to see where he might have lived.
There were two Richard Toomey/Tummey who lived in Churcham around this time and i need to see if there is a connection.
I know one of them was still living in Birdwood in 1802 but the other seems to have disappeared.
Thank you
Sid Toomey

My gt-gt-gt-gt-grandfather Richard Sterry married Ann Toomey (among the spellings) in 1794 at Minsterworth which is very close to Churcham, but I don't know of a connection between Ann and either of the two male Churcham Toomeys you're referring to. If you find such a connection I'd be most grateful to hear about it.

I have been looking for anything to do with any Toomey (plus varied spelling of this name) within the Churcham Parish in the Eighteenth Century hoping for a clue to take my branch of the family back further. I have not come across anyone born Ann Toomey in Churcham. If i do find anything i will definitely let you know.

In case you haven’t seen them already here are a couple of extracts from the BNA,

BNA Kentish Gazette - Friday 16 December 1785

A letter from Gloucester, dated Dec. 10, says, “William Crew, John Chapman, and William Matthews, three villains who years ago were confined in our Castle, were the perpetrators of the cruel robbery of Mrs, Fowles, at Huntley,—Matthews, who lives at Hampton, was observed by a neighbour to have in his house a new pair of women’s shoes, and a bag marked Fowles. The person read of the robbery, immediately apprehended Matthews, who confessed the fact and impeached his accomplices —John Chapman was apprehended at his work in this city ; but Crew is not yet taken. This is a fresh circumstance to prove the necessity of keeping felons in separate confinement. William Crew, not yet taken, is a native of Wotton-Underedge, a stout man, of a pale complexion, dark brown hair, about five feet ten inches high, and 37 years of age. The son of the widow Fowles, of Huntley, having had reason to suspect Richard Toomy, of Bully, of the robbery of his mother’s house, from his living an idle and dissolute life, repaired to his house, and examined the mould of his garden, where thieves usually conceal their booty. Here he found buried several sheepskins, which belonged to sheep stolen from Farmer Cannock, and other persons in that neighbourhood.—Toomy and his son have been since committed to the Castle.

BNA Hereford Journal - Thursday 06 April 1786

Of sixteen persons capitally convicted at Gloucester ten are left for execution, viz. William Crew, Wotton-Underedge, John Chapman, of Randwick, and William Matthews, Hampton, for breaking open the house of Mrs. Fowles, of Huntley; James Davis, of some place in Pembrokeshire, Joseph Fry and Samuel Ward, of the parish of Bitton, for burglaries , Thomas Russ, of Sutton, in Wiitshire, for . highway robbery ; Samuel Holloway, of Stroud, house-breaking; Richard Newman, of Wotton Basset, and William Whittick, of Midsomer Norton, Somersetshire, for horse-stealing.

These six were condemned, but afterwards reprieved, Hannah Veriby for shop lifting, Richard Toomey for sheep stealing, Thomas Hitchon for horse stealing, Elisha King for burglary, George Gay for house-breaking, and George Fry for burglary.

Mike, Thank you for this information. I had not seen it before. When you mention "BNS", does this indicate British Newspapers ? or could you provide me the link to the site ?
This information is exactly what I was looking for to provide a link to one of the Richard Toomey's of Churcham.
Do you know what castle the newspaper report is referring to. As i live in Australia, my knowledge of English Castles is limited.
Finding the connections to old ancestors really gives me a buzz and also headaches as more possibilities are opened to explore.
Thanks again
Sid Toomey

Wikipedia has a summary of Gloucester Castle and the history of its use as a gaol.

https://en.wikipedia.org/wiki/Gloucester_Castle

The BNA is the British Newspaper Archive and it can be accessed here,

http://www.britishnewspaperarchive.co.uk/

It can be free-searched but the full details of any article are available only on subscription. Since I have this I am happy to download anything of interest.

Hello Sid
I live in the area of Churcham parish which was once called Birdwood Common, in a house which was once owned by Toomeys. The title deeds tell us that John Toomey died in about March 1832 leaving his land to be shared by his two sons, John Toomey and Benjamin Toomey. We live in Benjamin’s house. It was lived in by Toomeys until 1979 and we bought it in 1984.

I have researched the Toomeys but have not as yet managed to get any further back that John who died in 1832. He was probably born c1775 or a little earlier, as he married in 1795. I don’t know if there is any link to the Richard Toomey you mention in your post.

I do have a copy of the inclosure map for Churcham, dated 1803, which shows that a Richard Toomey rented two small plots of land from the Dean and Chapter of Gloucester Cathedral. At this date the tenant of the plot where I live was unnamed. I obtained this map about 20 years ago and played around with it on the photocopier so that I could compare it with a modern map. It is interesting to see that many field boundaries are still the same. However, the small plots owned by Richard Toomey (and any buildings there may have been) appear no longer to exist, judging by modern maps. Richard’s plots were very close to the road leading to Solomon’s Tump, which I think has been mentioned in one of your posts. (As is ours, sometimes we are referred to as being in Birdwood and sometimes as Huntley, as people don’t know that the parish boundary runs down the middle of Solomon’s Tump Lane. I think our plot is about half a mile at most from where Richard’s were and I do wonder if there is a link there to be discovered.)

I often visit Gloucestershire Archives so will see what I can find out about the Toomey criminal records – not just a Richard in 1786, but also a John in 1865, a Benjamin in 1827 and a William in 1825 and 1832. The records for Gloucester Goal have a lot of interesting information, including a written description of the prisoner’s appearance. (I have an ancestor who spent a year in Gloucester Goal from 1866-67 – I found his prison record and the record of the court proceedings, including witness statements and his statement in his own words!) I will also have a look for Toomeys in the Churcham parish records pre-1800.

I will get back to you if I find anything about Richard Toomey, particularly his family.

Stephanie

Thank you for the information Stephanie. It is very much appreciated. Firstly , if you have the Inclosure map, would you mind replying giving the number of the plot the Toomeys lived in ? I have a copy of the map also, together with a list of the landowners at time of inclosure so i will be able to find it.
The Toomey family are really doing my head in. I am descended from William Toomey born in Churcham around 1785 but unable to find any record. I know that he lived in Birdwood for more than two Census returns. His next door neighbour was his son George. Other neighbours were stable for the same census returns. The cottage leased by Richard Toomey at time of inclosure together with some others nearby, four of them by a stream in the centre of the common, were demolished by 1882 with only a couple of old apple trees remaining in 1970 from the orchards. I have been able to plot them on modern maps.
If you can let me have your email address, i can send you the images i have showing the location of the old cottages on a modern map. If i knew how to put them on this site i would.
I have a theory that my ancestor William Toomey was a son of Richard Toomey who leased the cottage at Birdwood. I believe this Richard Toomey died in 1812 in Churcham. In all his life William Toomey listed his place of birth as Churcham.
in 1809 he married Elizabeth Burnett at Churchdown and his first born in 1810 at Churchdown was a son William. Then his next born was a daughter Harriet in Churcham in 1813. My theory is that he returned to Birdwood on the death of Richard in 1812 and took over the lease of the cottage. Just a theory. I think there is information in the Dean and Chapter of Gloucester archives. I have seen on line that there are bundles of documents relating to the cottages on Birdwood common owned by them. If you are going there i can send you the details of the ones i think might be fruitful. I would love to come to England to look through these archives but my wife is not interested in family history research but does love shopping. I am concerned about the effect on my finances.
Regarding your John Toomey. I believe he was born in Churcham 10th April 1774, with brothers Benjamin and Richard. his father was Richard Toomey (convicted of sheep stealing), Grandfather Thomas and Grandmother Mary.
I must express my sincere thanks to the members of this forum who in the past have provided me with invaluable information and also tips on how to interpret different information sources as well as providing links to new sites which have proved invaluable.

Hi Sid

From the notes I made 20 years ago, the plots rented by Richard Toomey were 31 and 32. John Toomey's land was roughly where plots 46 and 47 were.

I will certainly look at the Dean & Chapter records, if you could let me know which you think I should look at. I am going on Wednesday this week, but can't promise to look at everything then - time just seems to disappear when I am there - it might take a few weeks.

Strange that there is no record of William Toomey's baptism but having now looked at the Churcham parish records on Ancestry, the records for Toomeys are a bit haphazard and are difficult to tie together - marriages seem to be a bit thin on the ground!

I have now made myself contactable by email, if that helps.

Regards
Stephanie

I have compiled a timeline for Richard TOOMEY/TUMMY from information on this site, FamilySearch and Ancestry. The Richard TUMMY mentioned as a father in 1773/1774 seems to be the best candidate for the one committed in 1785 since he had a son of an age where it is possible he was also committed. I also wonder if he was the Richard TUMMY who married Hannah MASON in 1783 – there is an intriguing 6/7-year gap before any recorded children. Or perhaps there were three Richard TOOMEYs at this time?

1773 23/03/1772-3 baptism of Benjamin TUMMY, father Richard, mother Sarah
1774 10/04/1774 baptism of John TUMMY, father Richard, mother Sarah
